Legistlative Alert: Important Health Insurance Coverage Amendments Effective January 1, 2011

Family law practitioners are well aware of the importance of continuing health care coverage for children not only during the dissolution process but through emancipation Today, many people out of work and don't have health insurance as an employee benefit. Health care coverage must be given great care and attention during the pendency of the proceedings in both temporary child support orders and when drafting your marital settlement agreement. Under the current Family Code, the Court is required to order either parent or both to provide health insurance coverage.

Custody Change of Child's Residence

When a court considers a move away, the Court must decide de novo what physical custody arrangements would be in the child’s best interests assuming that the mother would be living in another state. Regretfully, the trial court attempted to determine a custody arrangement but miserably failed to analyze the issue on the presumption that the mother would be moving to Washington. This actual move should have been of no surprise to the Court as Mom moved to Washington in January after Mom and Dad ended their relationship in December 2007.
